By creating an account, accessing our platforms, downloading the mobile application or using our services, you agree to abide by these Terms, which include various mandatory guidelines, rules, and conditions. Along with these terms, we grant you an Individual Use License which is determined according to the plan you choose, which will be non-transferable and revocable, which could be subject to the service, plan or service purchased individually or by a company/entity to which you are related.

You can use these services only if you formalize a binding agreement with Risky ID by acquiring paid services as long as you accept compliance with these Terms and Conditions of Use.

When you create your Risky ID account and, therefore, when you use certain services, you must provide accurate and complete information, and you agree to update your information so that it remains accurate and complete. The use or access of children under 18 to our Services is prohibited.

You also agree that you will create, access and/or use only the account according to the plan you have contracted and that you will not share with any third party access or access information to your account.

Using our services does not give you ownership of any intellectual property rights of our Services or the content you access.

Any other use of the Risky ID platform other than the one for which it was created is prohibited.

We reserve the right to revise the Terms at our sole discretion at any time. Any revision of the Terms will be effective immediately after we publish it. In any change we make to the material of these Terms, we will follow the necessary steps to inform you of such changes. In any case, your continued use of the Services following the publication of such changes, with or without notice, constitutes binding acceptance of the revised Terms.

Although we do not routinely examine or monitor the content that users provide, we may delete or edit inappropriate content or activities that are communicated to us, or suspend, deactivate, or terminate a user’s access to a portion of or all of the Services.

The use of Risky ID Services is prohibited for:

• Promote and support illegal activities.
• Provide information to third parties about their situation or classification in the databases used by Risky ID, in order to provide assistance for the evasion of justice, the concealment of information and any other related crime.
• Use the Risky ID platform to expose or filter information from people who are involved in some investigation.
• Harass or offend other people or entities of any kind.
• It is not allowed to disseminate content directed to other people that may be abusive or that in some way may be inappropriate due to the knowledge of the information obtained in Risky ID.
• Make credible threats or organize acts of real violence. We do not allow genuine risk or physical damage or property damage to be created, that actually threatens people, private property or public safety, or that damage is organized or encouraged through the Services.
• Violate the intellectual property, privacy or other rights of other individuals or entities.
• Share content obtained in Risky ID, except in cases where the information is used for regulatory compliance or the requirement of the authorities.

Violation of these terms may mean the elimination or suspension of any relationship between Risky ID (Ideas Publishing Solutions) and the person, entity, company or institution that breaches them.

It is also not allowed:

• Sharing your password, allowing someone to access your account, or do something that could put your account in danger.
• Try to access another user’s account.
• Reproduce, transfer, sell, resell or otherwise misuse the information offered from our Services, unless you are specifically authorized to do so.
• Access, falsify or use private areas of our systems unless you are specifically authorized to do so.
• Breaking or circumventing our authentication or security measures or in some way proving the vulnerability of our systems or networks, unless you are specifically authorized to do so.
• Trying to apply reverse engineering to any part of our Services.
• Trying to interfere with any user, guest or network, for example by sending viruses, overloading, sending spam or bombarding the mail.
• Using our Services to distribute malware.
• To impersonate or misrepresent your affiliation with any person or entity.
• Encourage or help someone to do any of the things on this list.

Data Security

Risky ID maintains rigid security measures for user data, both of filial information and data related to the use of our services and platforms. Despite handling high cybersecurity standards, Risky ID cannot guarantee that unauthorized third parties cannot overcome our security measures. Please inform us immediately by email to [email protected], if there is a compromised or unauthorized use of your account or if you detect any suspicious activity related to our platforms.

Third-Party Content

Although most of the resources and services are developed by the Risky ID team, you will have the possibility to access and/or use the content provided by other users and/or other third parties and links to web pages and services maintained by third parties. Risky ID cannot guarantee that the content of those third parties does not contain material that you may find objectionable or inappropriate, or malware or other contaminants that could damage your computer, mobile device or any file it contains. Risky ID rejects any legal responsibility or obligation related to your access or use of such third party content.

 

Currency and Taxes

Unless stated otherwise, all prices are expressed in US dollars. Risky ID will only accept US dollars as a payment currency unless the following is specified at the beginning of the payment process. You are responsible for paying all applicable fees and taxes in a timely manner. If your payment method fails or your account is expired, we can collect the fees through other payment mechanisms.

Rates may vary based on your location and other factors, and Risky ID reserves the right to change any rate at any time at its discretion. All changes, updates or modifications will be effective immediately after the publication of the relevant services.

Withholdings and taxes from jurisdictions other than the United States must be paid by the customer.

Modify and Suspend Our Services

We are constantly changing and improving our Services. We may add or remove functions, features or requirements, and we may suspend or stop a Service completely. Consequently, Risky ID may suspend your use of any service for any reason. If the use of a paid service is suspended, a refund may be made. Neither Risky ID, nor Dow Jones Corporation, nor the sponsors and other business partners and their employees, nor their contractors and other agents will have any responsibility with you for such action.

Legal notices

The services and all content included are provided “AS IS” without warranty of any kind, explicitly or implicitly. You acknowledge and agree that any access or use of services, products, and platforms is at your own risk.

Risky ID and its parent company Ideas Publishing Solutions cannot guarantee that all politically exposed persons (PEPs), convicts of financial crimes from around the world and individuals/entities included in blacklists are within the database of Dow Jones Corporation. Risky ID assumes no responsibility for material, moral or legal damages generated by the information included or omitted in the database.

UNTIL THE LAW PERMITS IT, RISKY ID, ITS DIRECTORS, EMPLOYEES, TRADE PARTNERS OR AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR ANY LOSS OF BENEFITS OR OF INCIDENT OR FOREIGN , OR OF ANY LOSS OF DATA, USE, TRADE FUND OR OTHER INTANGIBLE LOSSES, RESULTING FROM: (A) YOUR ACCESS TO, USE OF, OR THE IMPOSSIBILITY OF ACCESSING TO OR USING THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY PARTY THAT IS NOT RELATED TO RISKY ID, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE OR ILLEGAL CONDUCT; OR (C) UNAUTHORIZED ACCESS, USE OR ALTERATION OF YOUR CONTENT OR INFORMATION.

YOU ACCEPT THAT ANY CAUSE OF ACTION RELATED TO THE SERVICES SHOULD BEGIN WITHIN ONE (1) YEAR AFTER THE CAUSE OF THE ACTION ARISES. OTHERWISE, SUCH CAUSE OF ACTION IS PERMANENTLY PROHIBITED.

Compensation

You agree to indemnify, defend and rid Risky ID of any responsibility for any claim, liability, expense, and damage, including attorney fees and costs, made by third parties related to (a) the use or attempted use of the Services that violate these Terms; (b) the violation, on your part, of any law or rights of any third party; or (c) any claim of infringement or misappropriation of intellectual property or other property rights.

Applicable Law and Jurisdiction

The Services are managed by Risky ID located in Lee County, Florida (United States). You agree that any dispute related to these Terms will be governed by the laws of the State of Florida, excluding your conflicts regarding legal provisions. You expressly accept the personal jurisdiction of and exclusive place in federal and state courts located and serving in Lee County, Florida as the legal forum for such disputes.

Registered Trademark and Copyright

Risky ID respects the intellectual property rights of our partner institutions and other third parties and expects our users to do the same when they use our Services.

Risky ID also respects the trademark rights of others. Accounts that have content that deceive others or that violate the registered trademark of others may be updated, suspended, disabled or canceled by Risky ID. If you suspect that someone may be using your registered trademark and in some way infringing our Services, please keep us informed.

Trial Periods

To avoid a charge during a free trial promotion, you must cancel your subscription before the trial period ends. Once the trial period is over, and in case the automatic affiliation to the tested service is contemplated, we will automatically charge the amount corresponding to the tested service.

Monthly Plans

Risky ID’s monthly plans can be canceled at any time, without penalty. Risky ID does not offer payment refunds related to monthly plans. If you cancel your subscription. You will continue to have access until the end of the acquired period, but you will not receive a refund, voucher, or any other method of a partial refund of the amount paid.

Automatic renewal and automated payment of the amount corresponding to each plan will be made on the same day of the month that the service was first acquired. At the end of each period of the monthly plan contracted, you can change your plan.

The Risky ID platform will make a progressive accumulation of unused screenings. For example, if a plan of 15 monthly checks is contracted and that month only 10 checks are used, the 5 unused checks will be added to the corresponding checks the following month.

The monthly PRO and ULTRA plans contemplate the creation of a maximum of 10 users. Additional users may be created for an additional cost, which may vary according to the number of additional users and based on commercial area strategies. Those interested in adding more users should check with the commercial area of ​​Risky ID.

The PRO and ULTRA plans include the batch screening service. Users must be uploaded to the platform only and exclusively with the Excel template provided by Risky ID. The platform will not process the data that is attempted to be uploaded using another template or the original modified template. Screenings in Risky ID usually generate results immediately; however, in the case of batch screenings, they may require more time, depending on the number of individuals or entities that must be checked. Mass checks of individuals and entities must be done separately, uploading separate files for each type of search.

Search Reports

The Risky ID platform generates a report in PDF format that shows the results of each search. The report can be printed, downloaded or sent by email. This report is issued exclusively in PDF format.

The reports are generated with the Risky ID and Dow Jones Corporation logos and contain the information with the specifications of the search performed by the user.

The report must not be modified, edited or altered in any way. The modification, edition or alteration of the reports completely annuls their validity for legal and regulatory compliance purposes and may result in the temporary or detrimental suspension of the user account that generated said report.
